Yes. A properly executed Islamic Will is fully legally valid under Australian law, as long as it includes required signatures, witness formalities, testamentary capacity, and clear intent. Our drafts follow each state's Succession Act and include a plain-English explanation of Islamic obligations, so your estate will be distributed with minimal resistance from probate registrars.

According to Islamic principles, up to one-third of your estate can be freely bequeathed to non-heirs, such as stepchildren, non-Muslim relatives, or charitable organisations. This is called the wasiyyah. Our team ensures these gifts do not infringe on the shares of compulsory heirs, and automatically adjusts “excess” gifts if needed.

Absolutely. A Waqf is a charitable endowment, or ṣadaqah jāriyah, which can be established through your Will using part of your wasiyyah. You can:

1. Create a new Waqf via deed after death,
2. Top-up an existing Waqf, or
3. Allocate your ⅓ to a registered charity (we include legal name and ABN). All options are drafted to comply with Shariah and Australian law.

You can appoint anyone over 18, but we recommend two executors: a trusted family member and a lawyer. Guardians should ideally be practising Muslims, as per Islamic obligations, but Australian law permits non-Muslim guardians too. Our drafts accommodate both views to provide flexibility and legal standing.

Under Islamic principles, adopted and step-children do not inherit by default. However, you can provide for them using the discretionary ⅓. We ensure these gifts are included appropriately in the Will without violating your Islamic obligations.
